Terms of Service

1. The service
The List is a curated last-minute hospitality staffing service operating in New York City. We connect venues with vetted independent contractors (1099) for short-notice shifts. The service is operated by The List NYC. Contact: roy@thelist.nyc. By using the website at thelist.nyc or receiving messages from us, you agree to these Terms and our Privacy Policy.
2. Who can use The List
Talent (contractors) join only by individual operator invitation following a vetting interview. Venues join by submitting a staffing request and accepting our venue agreement. You must be 18+ to use the service. We may suspend or terminate access for any user who violates these Terms, the venue or talent agreement, or applicable law.
3. SMS messaging program
This section is required by U.S. carrier rules for A2P 10DLC messaging.
- Opt-in. You opt in by entering your mobile number on thelist.nyc and checking a consent checkbox during signup or request submission.
- Message types. Shift offers, winner confirmations, venue logistics, operator follow-ups, and shift-cancellation notices. Operator-sent only.
- Frequency. Variable, typically 1–10 messages per week depending on shift availability and your participation.
- Message and data rates may apply. You are responsible for any charges your wireless carrier may impose.
- Opt-out. Reply

4. Independent contractor framing (talent)
Contractors placed through The List are independent contractors, not employees of The List or of any venue. The List is a staffing intermediary; it does not direct the day-to-day work product of contractors at a venue’s premises. Contractors are responsible for their own taxes and report income on Form 1099-NEC. A separate Independent Contractor Agreement governs the contractor relationship and is signed during onboarding.
5. Venue terms
Venues using The List agree to the venue services agreement presented at the time of first request submission, which covers per-placement fees, temp-to-perm conversion fees, payment terms, and conduct expectations. A complete venue agreement is executed before invoicing begins.
6. Payment and fees
Venues pay The List for placements and any conversion events as set out in the venue agreement. The List pays contractors per shift on terms agreed in the Independent Contractor Agreement. Tip payment policy follows New York State wage law; gratuities are paid to working contractors and not retained by The List except as permitted by law.
7. Conduct
Users agree not to: misrepresent identity or eligibility; use the service to harass another user; bypass The List to circumvent placement or conversion fees; scrape, copy, or resell content from the website. We may suspend access for violations.
8. Intellectual property
The List, the website, the curated contractor roster, and all related materials are the property of The List NYC. You may not copy, reproduce, or use them outside the purpose for which they were provided.
9. Disclaimers
The service is provided “as is.” The List makes no warranty that placements will be filled, that contractors will perform to a venue’s satisfaction, or that the website will be uninterrupted. We screen contractors but do not guarantee performance outcomes.
10. Limitation of liability
To the maximum extent permitted by law, The List is not liable for indirect, incidental, consequential, or punitive damages. Our aggregate liability for any claim arising out of or related to the service is limited to the fees paid to The List in the twelve months preceding the claim.
11. Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in New York County, New York.
12. Changes
We may update these Terms as the service grows. We will post the new effective date here and, when changes are material, notify active users by email or SMS.
